END USER LICENSE AGREEMENT (EULA)

This End User License Agreement ("Agreement") is a legal agreement between you ("User") and Oddshot Games ("Company") governing your access to and use of the Company's multiplayer video game, including any related services, features, or virtual content (collectively referred to as the "Game"). By downloading, accessing, or using the Game, you agree to the terms of this Agreement.

1. License Grant
Oddshot Games grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Game for personal, non-commercial purposes, subject to the terms of this Agreement. This license does not constitute a sale of the Game, and all rights, title, and interest in and to the Game remain with Oddshot Games.

2. Content Creation and Intellectual Property
a) Ownership of User-Generated Content
You retain ownership of any content you create related to the Game, including but not limited to videos, livestreams, reviews, and fan art ("User-Generated Content").

b) Monetization of User-Generated Content and Fan Content
You are permitted to monetize User-Generated Content, including videos, livestreams, and similar media, through advertisements, sponsorships, or other revenue-generating methods, provided such use complies with this Agreement and applicable laws.

For Fan Content such as renders, fan art and physical goods, you are allowed to monetize such works up to a maximum of 1,000 USD (or equivalent) in revenue per calendar year. Any earnings beyond this limit require prior written approval from Oddshot Games.

The creation, sale, or distribution of NFTs (Non-Fungible Tokens) or similar blockchain-based products using Oddshot Games' intellectual property is strictly prohibited under all circumstances.

c) Attribution
We appreciate when creators acknowledge Oddshot Games as the owner of the underlying intellectual property, but this is not required.

d) Reservation of Rights
Oddshot Games retains all rights to its intellectual property. Granting permission for User-Generated Content or Fan Content does not transfer ownership or grant additional rights beyond those expressly stated in this Agreement.

3. Account Suspension and Termination
Oddshot Games reserves the right to suspend, restrict, or permanently terminate your account or access to the Game at any time, without notice, if we determine, in our sole discretion, that you have violated this Agreement, engaged in prohibited conduct, or otherwise interfered with the integrity of the Game or its services.

4. Virtual Currencies and In-Game Items
The Game may include virtual currencies, items, or other in-game content ("Virtual Goods") that can be purchased or earned.

License: Virtual Goods are licensed, not sold, and may only be used within the Game.
Control: Oddshot Games may modify, manage, control, or eliminate Virtual Goods at any time without notice or compensation.
Finality: All purchases of Virtual Goods are final, non-refundable, and non-transferable, except as required by Belgian law.
Account Impact: Oddshot Games is not liable for the loss or unavailability of Virtual Goods due to account suspension, termination, or any other reason.

5. Server Availability
Oddshot Games does not guarantee that the Game or its servers will be available at all times or that access will be uninterrupted or error-free. Downtime may occur due to maintenance, updates, technical issues, or other reasons. Oddshot Games shall not be liable for any losses arising from server unavailability, regardless of duration.

6. Prohibited Conduct
You agree not to:
Use cheats, bots, or unauthorized software to gain an unfair advantage.
Exploit bugs, glitches, or vulnerabilities in the Game for personal gain or to disrupt others.
Harass, threaten, or engage in hate speech towards other players.
Sell, trade, or transfer your account, Virtual Goods, or Game license without prior written consent from Oddshot Games.

7. Intellectual Property
All rights to the Game, including its trademarks, copyrights, and proprietary technology, are owned by Oddshot Games or its licensors. Unauthorized reproduction, distribution, or use of the Game's content is strictly prohibited, except as expressly allowed under this Agreement.

8. Disclaimer of Warranties
The Game is provided "as is" and "as available," without any warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

9. Limitation of Liability
To the fullest extent permitted by Belgian law, Oddshot Games shall not be liable for any indirect, incidental, or consequential damages arising out of your use of the Game, including but not limited to loss of data, Virtual Goods, or account access.

10. Amendments
Oddshot Games reserves the right to modify this Agreement at any time. Continued use of the Game following any updates signifies your acceptance of the revised Agreement.

11. Governing Law and Jurisdiction
This Agreement shall be governed by and construed in accordance with the laws of Belgium. Any disputes arising from this Agreement or the Game shall be exclusively resolved by the courts of Ghent, Belgium.

By accessing or using the Game, you acknowledge that you have read, understood, and agreed to the terms of this Agreement. If you do not agree, you must not access or use the Game.
